Exclusive: Kate's Holding Off From Asking For Custody...For Now!

After filing for divorce against husband Jon on Monday, Kate Gosselin released a dramatic and cryptic statement that evening saying that over the course of the previous weekend, "Jon's activities have left me no choice but to file legal procedures in order to protect myself and our children."

Kate has yet to explain what Jon's troubling "activities" were that their eight children needed protection from — but Star has learned that she didn't ask for custody of their kids in her divorce filing!

"The filing does not contain a custody count at this time," Kate's Norristown, Penn.-based divorce attorney, Cheryl Young, tells Star in an exclusive interview. "Both parties are trying to work this out together behind the scenes as amicably as possible." According to records, Jon is being represented by attorney Charles Meyer.

There was some mystery — and legal questions — as to why Kate, who lives with Jon in the Berks County town of Wernersville, filed her divorce forty miles away in Norristown, the county seat of Montgomery County. While Pennsylvania law states that a divorce action must be filed in the petitioner's county of residence, "the action can be filed in a different county if both parties agree to it beforehand," says Young. "That was the case in this action."

The attorney adds that Montgomery County was chosen for convenience because both Jon and Kate's divorce attorneys are based there. And given the media scrutiny of the couple, "we felt that filing in a different county might make for a calmer environment," admits Young, who was referred to Kate by another attorney.

The divorce action (below) shows that Kate and Jon listed a Sinking Spring, Penn., address — "possibly a business address," says Young — rather than their home address in Wernersville. Per Montgomery County law, the actual divorce file is normally sealed and not available to the public.

If the kids need protecton, it's NOT from their father Jon, but rather that "CRAZY FREAK" they are unfortunately supposed to call their mother. She needs to be put 6 feet under before she ruins their beautiful lives. Jon and his children deserve so much better. They deserve someone who loves them not someone with the sole intention of using them for her own fame & fortune. She needs to be stopped before it's too late for those children to be saved.

I understand why they would get a divorce..They both have their flaws...Like Kate she is wayy to controlin and bossy..But Jon isn't the biggest help with kids..But kate does treat jon reallly bad but sometimes he desrves it..

Well sweety, see the things with guys are that there so confusing.
You cannot tell whether there in love with you or not. I have a bf and i love him very much so.Right now he probably has mixed feelings about you but not sure how to express them. So just go with it. Talk to him and have fun. Tootles!!!!!!!!!!!

Kate is awful to Jon. Take this as a tip ladies, you can't treat your husbands like dirt and then expect them to remain faithful and loyal. If it has been Jon talking down to Kate and treating her like dirt, the attacks on Jon would have been monstrous but since it was the wife heaping verbal abuse, no one says anything. Spouses should never verbally abuse one another, no matter the gender.

i realy dont think kate should even beable to be with the kids unitended because she is unfit she is using these kids for her publisity and hello thats called child labor and the way she treats them is terrible..hitting them,and revusing to give them water and just drink it right in front of them then just tell them no..i think she needs some serious anger managment.ever sice shes ben doin this show she has just become so vain and puthetic!!

This whole thing between Jon and Kate has nothing to do with the tv show!! More than likely it was bound to happen with or without the show. I don't see why ppl are bashing them and bashing the show..There's really no point to it. Right now their doing what's best for themselves and for the kids.

I think Jon should have given his head a shake....8 kids and a loving wife. Ya ok sure Kate can be vocal sometimes....but so can I and everyone else in the world. He should not have renewed his wedding vows to her if he had these feelings...It's not like this popped out of the blue or anything. I'm glad Kate is strong enough to go through this for her self and her kids. She is doing the right thing. Jon is a little boy not a man and if he wants to have so called pajama parties with teachers...he needs to be with someone just as lo down, scuzy and scummy like him. Love the Kids though, they are great, lets just hope they don't think they are hated by their dad, or mom for that matter. If Jon wasn't happy, he should have said something to Kate...like i mean they have been married for like 10 years ! I think she deserves better than that I think...Don't you ? anyways Kate...all the power to you Girl...and just know that you have a whole family of supporters that are with you all the way.

Kate is way too bossy. And he can be an a$$ sometimes. In a way they are meant for each other, but I'm over their drama...next story please.
