Britney Baby Battle: Why Did The Judge Side With Kevin?

Things just went from bad to worse for Britney Spears. On Monday, Oct. 1, the judge involved in the Spears/Federline custody battle ruled that the singer must physically hand over her two sons to their father, Kevin Federline, at noon on Wednesday, Oct. 3, until further notice.

So why did the judge lean in Britney's ex-husband's direction? Star asked two experts knowledgeable in California law to weigh in on the matter.

John Schweitzer, a family law attorney with the Law Office of Nancy Stassinopoulos in San Diego, tells Star, "I think the judge felt that in balancing all of the evidence collected, the welfare, health and safety of the children would be better met with Kevin. I also think the judge made his decision based on credibility and on what both parents are saying. Right now he likes what Kevin has to say more than Britney."

Aside from failing to prove Britney is a fit mother, Judge Toler of the TV show Divorce Court adds, "The fact Britney has been driving without a valid driver's license shows me how she has no respect for the law. In my opinion, this is just another reason on top of her reported drinking and alleged drug use on which could have possibly changed the judge's mind, assuming he knew this before Monday."

According Schweitzer, "If Britney rehabilitates herself and gets back on the right track with her character the courts will look positively on that. For his part, Kevin needs to remain on his best behavior."
